Welcome to Elegant & Luxurious. These Terms of Service (the “Terms”) govern your access to and use of elegantluxurious.com (the “Store”) and any purchase you make from us. Please read them carefully before placing an order. By using the Store or placing an order, you confirm that you have read, understood and agreed to these Terms, together with our Shipping Policy, Refund Policy and Privacy Policy, which form part of this agreement.
1. Who We Are

In these Terms, “we”, “us” and “our” refer to Elegant & Luxurious, and “you” refers to the person using the Store or placing an order. A “consumer” is an individual who buys products for purposes that are outside their trade, business or profession.
2. Eligibility
You must be at least 18 years old, or the age of majority in your country of residence, to place an order. By placing an order you confirm that you meet this requirement and that the information you give us is accurate and complete.
3. Products and Descriptions
We work to describe and photograph our products as accurately as possible. However, colours may appear differently on different screens, and packaging, formulations, scents, sizes and labelling may vary slightly between production batches or from the images shown. Product availability is limited and may change without notice. We may limit quantities, discontinue products, or refuse an order where stock is unavailable.
4. Health and Safety Information
Our products include skincare, cosmetics, hair and body care, essential oils and dietary supplements. Please read the label and ingredients list of every product before use and follow the directions provided.
- Do a patch test before first use and stop using a product if irritation occurs. Do not use products containing ingredients you know you are allergic or sensitive to.
- Products are for external use only unless clearly labelled otherwise. Avoid contact with eyes. Essential oils should be used as directed and never ingested unless the label explicitly says so.
- Dietary supplements are not medicines, must not replace a varied and balanced diet, and should not be taken in excess of the recommended daily dose. Keep out of the reach of children. If you are pregnant, breastfeeding, taking medication or have a medical condition, consult a healthcare professional before use.
- Information on the Store is provided for general purposes only and is not medical advice. Our products are not intended to diagnose, treat, cure or prevent any disease.
5. Orders and Formation of the Contract
When you place an order, you are making an offer to buy the products in your basket. We will send an email confirming that we have received your order, but this is not acceptance. A binding contract between you and us is formed only when we dispatch your products and send you a shipping confirmation. We may decline or cancel an order, in whole or in part, for reasons such as product unavailability, an obvious pricing or description error, suspected fraud, or a problem with payment or delivery details. If we cancel an order after you have paid, we will refund you in full.
6. Prices and Payment
All prices are shown in euros (EUR). Applicable taxes, such as VAT, and shipping costs are displayed at checkout before you confirm your order. Prices may change at any time, but changes do not affect orders we have already accepted. Payments are processed securely through Shopify Payments and other payment providers made available at checkout; we do not store your full card details. We may carry out verification and fraud-prevention checks before accepting an order, and an order may be delayed or cancelled if verification cannot be completed.
Although we take great care, some prices may occasionally be displayed incorrectly. If we discover a pricing error after you have placed an order, we will contact you to confirm the correct price and give you the choice to proceed at the correct price or cancel with a full refund.
7. Discount Codes and Promotions
Discount codes and promotions are valid only for the period and conditions stated, cannot be exchanged for cash, and may not be combined unless we say so. We may withdraw a promotion at any time, without affecting orders already placed under it.
8. Shipping and Delivery
Shipping rates, dispatch times and estimated delivery windows are set out in our Shipping Policy. Risk of loss or damage to the products passes to you when the products are delivered to you or to a person you have named to receive them.
9. Right of Withdrawal, Returns and Refunds
If you are a consumer, you have a statutory right to withdraw from your purchase within 14 days of receiving the products, subject to the exceptions set out in our Refund Policy and in applicable law (including sealed hygiene products that have been opened and custom-made products). The Refund Policy explains how to exercise this right and how refunds are made.
10. Legal Guarantee of Conformity
Under Italian and EU consumer law, products must conform to the contract of sale. If you are a consumer, you are entitled to the legal guarantee of conformity for at least two years from delivery, and to the remedies provided by law (repair or replacement, price reduction or refund). Nothing in these Terms limits those rights. If you believe a product is defective, please contact us promptly with your order number and photos.
11. Intellectual Property and Brands
All content on the Store, including text, graphics, logos, images, layout and software, belongs to us or our licensors and is protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute or use it for commercial purposes without our written permission. Names, logos and trademarks of third-party brands that appear on the Store belong to their respective owners and are used only to identify the products offered. Their use does not imply any affiliation with, or endorsement by, those owners.
12. Acceptable Use
You agree not to use the Store for any unlawful purpose; to attempt to gain unauthorised access to the Store, our systems or other users’ data; to introduce viruses or other harmful code; to use automated tools to scrape or overload the Store; to submit false or misleading information; or to place orders in bad faith or for purposes of resale where this is not permitted. We may suspend or restrict access to the Store if these Terms are breached.
13. Third-Party Links and Services
The Store may contain links to third-party websites or services, and relies on third-party providers such as Shopify, payment processors and carriers. We do not control and are not responsible for their content, policies or practices. Your use of any third-party service is governed by that party’s own terms.
14. Personal Data
We handle your personal data in accordance with our Privacy Policy, which explains what we collect, why we collect it and your rights under applicable data-protection law, including the GDPR.
15. Disclaimers and Limitation of Liability
We provide the Store and its content on an “as is” and “as available” basis and do not guarantee that it will be uninterrupted, timely or error-free. To the fullest extent permitted by law, we are not liable for indirect or consequential losses, or for loss of profit, business or data, arising from your use of the Store or the products, and our total liability to you for any claim relating to an order will not exceed the price you paid for the products concerned.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or wilful misconduct, for defective products, or for any other liability that cannot be excluded or limited under applicable law. Nothing in these Terms affects the statutory rights you have as a consumer.
16. Changes to These Terms and to the Store
We may update these Terms from time to time, for example to reflect changes in law or in how we operate. The version in force on the date you place your order applies to that order. We will post the updated Terms on this page and revise the “Last updated” date above. We may also change, suspend or discontinue any part of the Store at any time.
17. General
These Terms, together with the policies referred to in them, are the entire agreement between you and us about your use of the Store and your orders. If any provision is found to be invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce any right does not mean we have waived it. We may transfer our rights and obligations under these Terms to another business, and you may not transfer yours without our written consent.
18. Governing Law and Disputes
These Terms and any contract of sale between you and us are governed by Italian law. If you are a consumer, you also keep the benefit of any mandatory consumer-protection provisions of the country where you live. If you are a consumer, you may bring proceedings in the courts of your place of residence or domicile, as provided by law. We encourage you to contact us first so that we can try to resolve any concern quickly and amicably; you may also use any out-of-court dispute resolution body that is available to you under applicable law.
